terms of service acceptable use policy
Ataraxy WebHosting provides low cost, quality webhosting to many clients, and the space we provide is used for a variety of uses. In an attempt to protect each valued client, the following guidelines are enforced. Each policy on this page is to be adhered to, by each service user, with no exception. Ataraxy WebHosting will be the sole arbiter in any decision made.
Privacy
Ataraxy WebHosting values it's service user's privacy and to that end will not divulge customer details to any third party. No account holder should reveal their username/s and/or password/s to any third party. Responsibility of password/s and username/s belongs to the account holder, and shall not be revealed by us to any other. Lost username/s and password/s must be retrieved by using our Client Area. In the event of the Client Area being unreachable and requests for lost information being made via e-mail, random security questions will be asked. Client e-mail and accounts will not be monitored by Ataraxy WebHosting unless requested to do so by an enforcer of the law. In the event of any unlawful activity being undertaken on our systems, Ataraxy WebHosting will report the action to the relevant authority and will suspend the account pending investigation. Accounts terminated as a result of our investigation will not be eligable for a refund. Ataraxy WebHosting is the sole arbiter of any decision made.
Data Backup
Each client will have the means to backup their data - e-mails via POP and account data via FTP or CPanel. Each service user must ensure that regular backups are completed. Ataraxy WebHosting backs up its entire systems periodically. This service should not be seen as an excuse to delay backups and individual account restores may be subject to a fee of $5.00 at our discretion. Ataraxy WebHosting therefore will not be responsible for loss of data or for the loss of business as a consequence of lost data.
Acceptable Use of Services
- Space and hosting supplied by Ataraxy WebHosting must only be used for lawful purposes. Transmission, storage or presentation of data, information or material deemed not lawful is against company policy and any site containing such material will be suspended with immediate effect pending enquiry.
- Sites containing pornographic content are not acceptable, including, but not limited to pornographic images or any matter deemed offensive. Sites containing such material will be suspended with immediate effect pending enquiry. Links to such material is not prohibited.
- Any sites containing sexist, racist, homophobic or any site offending minority groups, or with inappropriate content will not be tolerated at Ataraxy WebHosting, any site containing such material will be suspended with immediate effect pending enquiry.
- Any website hosted by Ataraxy which uses a high amount of server resources, i.e. CPU time, memory usage or network resources will be informed and given the choice of reducing the resources used or paying extra for the resources. Ataraxy remains the sole decision maker in such cases.
Banned Scripts
We do not allow the use of the following scripts on our servers, and all clients with reseller privileges must ensure that their subaccounts are aware of this:
- UltimateBBS
- IkonBoard
- All versions of YABB forum
- Proxy scripts
- IRC scripts
- Anonymizer
- Chat rooms not included as standard in the CPanel
- phpShell and similar command execution scripts
- FormMail
Bandwidth
All accounts with Ataraxy WebHosting are allocated a specific amount of bandwidth (data transfer). Any account that exceeds this bandwidth limit will be subject to a fee, detailed on the Ataraxy WebHosting homepage. We are not obliged to contact you regarding bandwidth exceeding. You must contact us should you wish to purchase extra transfer limits.
Termination of Contract
Any behaviour leading to termination of contract will result in a cancellation fee. Any existing credit on the clients account will be refunded, minus our cancellation fee of $50.00.
Account Cancellations
Account cancellations must be requested via the Client Billing Area, or the HelpDesk. Cancellations will no longer be accepted via e-mail. Monthly contracts can be terminated at any time, and no refund will be given. Hosting will continue to run until the day the cancelled payment is due. Yearly paid contracts will receive their remaining full months in return. Any domain name registered for free by Ataraxy WebHosting in conjunction with a promotion will remain property of Ataraxy WebHosting and may be sold on at our discretion, unless the registration fee of $8.00 is paid.
30 Day Money Back Guarantee
Monthly paying clients will receive their initial months payment back, if the account is cancelled within 30 days. Yearly clients will receive their yearly payment, minus any domain name registration fees ($8.00). Cancellations must be notified by the Client Billing Area, or the HelpDesk.
Payment
Ataraxy WebHosting will always endeavour to send invoices monthly, and all payments will be automatically billed using the chosen payment method, unless otherwise agreed. Some clients may require manual payment. It is the responsibility of the client to make sure they have sufficient funds to cover billing. In the event that payment is not made, the account will be suspended and the account holder contacted by e-mail. A total of 30 days will be given to the account holder to make payment, beginning on the invoice date - in the event of no payment after this period, the account will be terminated at our discretion.
Refusal of Service
Ataraxy WebHosting reserves the right to suspend, terminate and delete accounts at our sole discretion.
Server Uptime
While Ataraxy WebHosting strives to deliver the best possible service to our clients, technical problems can and do occur. Any downtime will be investigated as soon as we are aware of the problem and our clients will be notified of any problems. Should there be a severe error with the server, we will provide temporary hosting until the problem is resolved. We cannot be held responsible for any data loss in these cases, and server downtimes will not be used as a reason for refund, when we will provide temporary hosting at our cost. Ataraxy WebHosting will not be held liable for downtime caused by human error, or any disaster which may occur. Downtime as a result of another account on the server will be investigated, the offending account suspended and the server bought back online. Ataraxy WebHosting cannot guarantee against this, and will not be held liable in the case of such downtime.
